    DISTANCE SALES AGREEMENT ("Agreement")


    This Distance Sales Agreement has been prepared in accordance with the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014, and numbered 29188, and is based on this regulation.


    1. PARTIES

    This Distance Sales Agreement ("Agreement") is electronically executed between the Buyer ("BUYER"), whose address is specified in Article 6, and Teotex Tekstil A.Ş., located at Mimarsinan Mh. Gürses Sk. No: 1 34935 Sultanbeyli, Istanbul ("SELLER"), under the following terms and conditions.


    2. DEFINITIONS

    In the implementation and interpretation of this Agreement, the terms written below shall refer to the explanations given next to them:

    • BUYER: The real or legal person who acquires, uses, or benefits from a product or service for non-commercial or non-professional purposes.
    • Minister: Minister of Trade.
    • Ministry: Ministry of Trade.
    • Service: Any consumer transaction that does not involve the supply of goods, performed for a fee or benefit or promised to be performed.
    • Website: The website www.monpeostore.com owned by the SELLER.
    • Law: Consumer Protection Law.
    • SELLER: A real or legal person who offers goods to the consumer for commercial or professional purposes, including public legal entities, or acts on behalf or account of the supplier.
    • Order Placer: The real or legal person who places an order through the website or mobile application of Teotex Tekstil A.Ş.
    • Agreement: This Distance Sales Agreement between the SELLER and the BUYER.
    • Parties: The SELLER and the BUYER.
    • Product(s): Any movable goods subject to shopping, residential or holiday properties, and any software, sound, image, and similar products prepared for use in electronic media.
    • Regulation: Distance Contracts Regulation.


    3. SUBJECT

    This Agreement has been prepared in accordance with the Law on Consumer Protection No. 6502 and the Distance Contracts Regulation. The Parties acknowledge and declare that they understand and accept their obligations and responsibilities under the said Law and Regulation. The subject of this Agreement is to determine the rights and obligations of the Parties in accordance with the provisions of the Law on Consumer Protection and the Distance Contracts Regulation regarding the sale and delivery of the product specified below, whose qualifications and total sales price, including taxes, are stated, and which the BUYER has ordered electronically through the SELLER's website. The prices listed and announced on the website are the sales prices. The announced prices and commitments are valid until updated and changed. Prices announced for a limited time are valid until the specified period ends, and promotional products are limited to stock availability.

    If the billing and delivery addresses are the same, the invoice will be delivered with the order; otherwise, the invoice will be sent via email.


    8. PRODUCT(S) SUBJECT TO THE AGREEMENT

    8.1. The main features (type, quantity, brand/model, color, number) of the goods/service are available on the SELLER's website. You can review the product features during the promotional period.

    8.2. The prices listed and announced on the website are the sales prices. The announced prices and commitments are valid until updated and changed. Prices announced for a limited time are valid until the specified period ends.

    8.3. The total price, including all taxes, of the goods or services subject to the contract is shown in the table below.

    8.4. The shipping cost and any additional fees, such as taxes and charges, are to be paid by the BUYER. If the SELLER has committed to covering the shipping cost, the relevant condition must be met by the BUYER.


    9. GENERAL PROVISIONS

    9.1. The BUYER acknowledges that they have read and confirmed the pre-information regarding the fundamental characteristics of the product, the sales price and payment method, and the delivery on the SELLER’s website and that they have provided the necessary confirmation in electronic form. The BUYER confirms that they have obtained the address, main features of the ordered products, total price including taxes, payment and delivery information correctly and completely before confirming this Agreement electronically.

    9.2. The ordered product will be delivered within the legal period of 30 days, depending on the distance of the BUYER's residence, as stated in the pre-information section of the website. If the SELLER fails to fulfill this obligation within the specified period, the BUYER may terminate the Agreement.

    9.3. The SELLER is responsible for delivering the product under the conditions specified in the order, in compliance with legal regulations, and free from defects.

    9.4. If the payment for the product is not made or is canceled by the bank, the SELLER is relieved of the obligation to deliver the product.

    9.5. In case of unauthorized use of the BUYER's credit card after the delivery of the product, the BUYER is obligated to return the product within 3 days at their own expense.

    9.6. If unforeseen circumstances prevent delivery within the contractual period, the BUYER has the right to request the cancellation of the order, the replacement of the product with an equivalent, or a postponement of the delivery until the obstacle is removed.

    9.7. The BUYER has the right to withdraw from the contract within 14 days without giving any reason.

    9.8. This Agreement is subject to Turkish Consumer Law, and any disputes arising shall be resolved by the Consumer Arbitration Boards and Consumer Courts within the specified monetary limits.
